Tennessee Baseball Star Sues NCAA Over Eligibility Battle

A Tennessee baseball player has taken legal action against the NCAA in a bid to secure another year of eligibility.

Alberto Osuna, who recently joined the Tennessee Volunteers, has filed a lawsuit challenging the NCAA’s eligibility rules. His case echoes Vanderbilt football’s Diego Pavia, who successfully sued the NCAA over JUCO eligibility concerns and won his case, offering hope for Osuna’s claim.

The lawsuit argues that enforcing certain NCAA Bylaws against Osuna violates the Sherman Antitrust Act and would cause him significant harm. Osuna, who played two years at a junior college before spending three years at UNC Chapel Hill, now seeks a fourth year of Division I baseball with Tennessee.

With a pending NCAA waiver, Osuna’s case adds to the growing legal challenges against the association’s eligibility policies.
